This Privacy Policy explains how Buzz International Pty Ltd (ACN 624 656 944) (Buzz or ClevaQ) collects, uses and discloses personal information in accordance with the Privacy Act 1988 (Cth).

In this Privacy Policy:

(a) Capitalised terms are as defined in our terms and conditions.

(b) ClevaQ is the app owned by Buzz

(c) Member means a member creating an account with ClevaQ.

(d) Personal Information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether the information or opinion is recorded in a material form or not.

(e) Visitor means someone using ClevaQ as guest.

1. Personal Information

(a) What ClevaQ Collects and How It Is Used.

ClevaQ collects information in different ways from visitors and members who access ClevaQ through the app or website. We use this information primarily to provide a customised experience as you use ClevaQ.

(b) We may collect your:

(i) name, email, phone number;

(ii) transaction and order data;

(iii) device data (IP address, browser, usage);

(iv) location data (if enabled).

(c) We may disclose personal information to:

(i) Operators to fulfil orders;

(ii) Merchants or payment processors to process payments;

(iii) cloud and IT providers;

(iv) analytics and marketing providers;

(v) regulators where required.

(d) We may use Google Analytics to collect and process data, including when you use third party Platforms or apps.

(e) We collect and use personal information for the following purposes:

(i) to facilitate the provision of Products or Services by the Venue to you;

(ii) to provide information to you;

(iii) for record keeping and administrative purposes;

(iv) to improve and optimise our service offering and customer experience;

(v) to comply with our legal obligations, resolve disputes or enforce our agreements with third parties;

(vi) to send you marketing and promotional messages and other information that may be of interest to you and for the purpose of direct marketing (in accordance with the Spam Act). In this regard, we may use email, SMS, social media or mail to send you direct marketing communications. You can opt out of receiving marketing materials from us by using the opt-out facility provided (e.g. an unsubscribe link);

(vii) to send you administrative messages, reminders, notices, updates, security alerts, and other information requested by you; and

(viii) We may disclose your personal information to cloud-providers, contractors and other third parties located inside or outside of Australia. If we do so, we will take reasonable steps to ensure that any overseas recipient deals with such personal information in a manner consistent with how we deal with it.

2. Registration

(a) Members may be asked to provide certain personal information when they sign up for to use ClevaQ including name, address, telephone number, and the type of personal computer being used to access the Services. The personal information collected from members during the registration process is used to manage each member’s account (such as for billing purposes). This information is not shared with third parties, except as outlined hereunder or in special circumstances in compliance with legislation. ‍

(b) However, in instances where ClevaQ and a partner jointly promote our Services, we may provide the partner certain aggregated personal information, such as the name, address, and username of persons who subscribed to the Services as a result of the joint promotion for the sole purpose of allowing us and the partner to assess the results of the promotion.

(c) In this instance, personal information may not be used by the partner for any other purpose. We may also generate non-identifying and aggregate profiles from personal information members provide during registration (such as the total number, but not the names, of members). As explained in more detail below, we may use this aggregated and non-identifying information to sell advertisements that appear on the Services.

3. Overseas Disclosure

We may disclose personal information to recipients located outside of Australia. In such cases, We will take reasonable steps to ensure overseas recipients comply with the Australian Privacy Principles or are subject to substantially similar laws.

4. Marketing

Upon registration or use of the ClevaQ Platform, you will automatically opt in to our marketing communications. As a consequence, we or the Operator, may send marketing communications to you. You may opt out at any time by e-mailing us at https://www.clevaq.com/contact-us or using any opt our feature in our (or the Operator’s) marketing e-mails.

We may use de-identified data for analytics and product improvement.

6. ClevaQ Partners and Sponsors

(a) Some products and services may be offered to visitors and members in conjunction with an affiliate, independent contractor seller or non-affiliated partner. To provide visitors and members some of these products and services, the partner may need to collect and maintain personal information. In these instances, you will be notified before any such data is collected or transferred and may decide not to use that particular service or feature.

(b) Additionally, our partners may have advertisements or co-branded Web Pages that are cosponsored by an affiliate, independent contractor seller, or non-affiliated partner. ClevaQ may share non-identifying and aggregate information (except as described above), but not personal information, with such partners in order to administer the co-branded products or services offered.

(c) If you order services or products directly from ClevaQ we will use the personal information you provide only to process that order. We do not share this information with outside parties except to the extent necessary to complete that order.

7. Online Advertisements

(a) ClevaQ may display online advertisements. In those cases, we share aggregated and non-identifying information about our visitors and members collected through the registration process as well as through online surveys and promotions with these advertisers.

(b) Additionally, in some instances, we use this aggregated and non-identifying information to deliver tailored advertisements or joint ventures. For instance, an advertiser or joint venture company tells us the audience they want to reach and provides us an advertisement tailored to the audience. Based upon the aggregated and non-identifying information we have collected, we may then display or send the advertisement to the intended audience. ClevaQ does not share personal information about its visitors or members with these advertisers or joint venture companies.

8. Responses to Email Inquiries

When visitors or members send email inquiries to ClevaQ, the return email address is used to answer the email inquiry we receive. ClevaQ does not use the return email address for any other purpose and does not share the return email address with any third party.

9. Voluntary Customer Surveys

(a) We may periodically conduct both business and individual customer surveys. We encourage our customers to participate in these surveys because they provide us with important information that helps us to improve the types of products and services we offer and how we provide them to you. Your personal information and responses will remain strictly confidential, even if the survey is conducted by a third party. Participation in our customer surveys is voluntary.

(b) We may take the information we receive from individuals responding to our Customer Surveys and combine (or aggregate) it with the responses of other customers we may have, to create broader, generic responses to the survey questions (such as gender, age, residence, hobbies, education, employment, industry sector, or other demographic information). We then use the aggregated information to improve the quality of our services to you, and to develop new services and products. This aggregated, non-personally identifying information may be shared with third parties.

(a) It is ClevaQ’s policy not to use or share the personal information about visitors of members in ways unrelated to the ones described above without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.

(b) However, we may disclose personal information about visitors or members, or information regarding your use of ClevaQ for any reason if, in our sole discretion, we believe that it is reasonable to do so, including: credit agencies, collection agencies, merchant database agencies, law enforcement, or to satisfy laws, such as the Privacy Act, regulations, or governmental or legal requests for such information; to disclose information that is necessary to identify, contact, or bring legal action against someone who may be violating our Acceptable Use Policy or Terms Of Service, or other user policies; to operate the Services properly; or to protect ClevaQ and our members.

(c) If you are a visitor or member we may use a cookie to save your settings and to provide customisable and personalised services. These cookies do not enable third parties to access any of your customer information. Additionally, be aware that if you visit other Web sites where you are prompted to log-in or that are customisable, you may be required to accept cookies.

(d) Advertisers and partners may also use their own cookies. We do not control the use of these cookies and expressly disclaim responsibility for information collected through them.

(e) We use cookies and similar technologies for analytics and performance.

11. ClevaQ’s Commitment to Children’s Privacy

We do not knowingly collect personal information from individuals under 18.

Please remember that any information you may disclose in any member directory, forum or other public areas of our websites or the Internet, becomes public information. You should exercise caution when deciding to disclose personal information in these public areas.

13. ClevaQ’s Commitment to Data Security

ClevaQ has security measures in place to protect the loss, misuse, and alteration of the information under our control. While we make every effort to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party “hackers” from illegally obtaining this information.
